By using goldenrose.co website, you agree on the terms and conditions set forth herein, which include every detail hereinafter. It also confirms your commitment to response to the content of the agreement of goldenrose.co.

The following terms and phrases shall be interpreted according to the definitions provided next to each of them, unless otherwise explicitly provided in the text or required by the context:

·  Regarding your usage to the website, referred to hereinafter as “Services Agreement”.

This agreement shall enter into force once you accept “agree” option.

This preamble is integral part of the agreement.

1. Website membership shall be granted to persons over 18 years old only. 

2. Persons whose memberships in goldenrose.co are cancelled shall not be allowed to use the website. 

3. You should adhere to all applicable laws regarding the regulation of e-trading. 

Once you apply for membership, you will be required to disclose specific information and to choose user name and password to use when logging in the site. Upon the acceptance of registration, you will be a member on the website, thus you will agree that: 

1.      You are responsible for maintaining the confidentiality of your account and your password, and identifying who allowed to access and use your account. You will agree to immediately notify
“goldenrose.co” of any unauthorized use of your password and account or any other breach of your confidential information. 

2.      In, anyway, “goldenrose.co” shall not be liable for any loss may occur to you directly or indirectly, morally or materially, as a result of disclosure of your user name and password.

3.      You are responsible for maintaining the use of “goldenrose.co” seriously and credibility, and you shall be obligated to indemnify “goldenrose.co” of any losses directly or indirectly that may be occurred to “goldenrose.co”, as a result of any illegal, true or authorized use or from any other person has accessed to your account on the site whether to perform services or otherwise using your user name and password, either you authorized him or not.

6.      “goldenrose.co” has the absolutely free and at any time to conduct any investigation deemed necessary (directly or by third party), and to ask you to disclose additional information or documents -whatever its size - to prove your identity and/or property of your financial instruments. 

7.      In case of failure to comply with any of the above mentioned, “goldenrose.co” has the right to stop or cancel your membership and ban you from the site. We also maintain the right to cancel any uncertain or unproven accounts, dealings or accounts that have no activity for a long time.

1. Pictures of digital jewelry are carefully chosen on the site, but the product colors may vary relatively from screen to screen. Some products may appear larger or smaller than its real size on the site.

2. The information may not be 100% accurate, there is a possibility of human mistake, the management of the site shall have the right to change any information on the site at any time whether for the product or other information.

3.  The weight of the product mentioned at the site may vary with 10% of the weight mentioned in each product, the weight also includes stones, such as: Zircon, enamel or any other colours to decorate the product.

4. All products are priced with USD, and you can also choose other currencies.

5. The product price consists of the price of gold + manufacturing and designing fees + stones.

6. If the product weight exceeds 10% more or less than the weight mentioned on the site, we will follow up and coordinate with the Buyer within the policy of retrieval and recovery described later in this agreement.

1. You agree to contact with you by e-mail or by posting promotional advertisements on the site. You agree that all agreements, advertisements, data, and other communications provided electronically take the place of the same written to meet the legal requirements. 

2. During your membership, “goldenrose.co” will send promotional, e-mails to notify you with any changes, procedures or new promotional activities may be added to the site. 

3. You have the right as a user to confirm that you do not wish to receive promotional e-mails, and you can cancel receiving such massages by clicking “Do not receive promotional e-mails” option at the bottom promotional and advertising e-mails.

1.You acknowledge and agree that “goldenrose.co” will notify you about any amendment on User Agreement, and hereby you will double your obligations or decrease your rights in accordance with any amendments of Usage Agreement. 

2. You agree that “goldenrose.co”, in its sole authorization and without occurring legal liability makes amendments or sub-amendments on such agreement without requiring additional your acceptance, at any time and immediately, by posting an advertisement  about the amendment on the site. 

3. You acknowledge that “goldenrose.co” is not an auction or a bank and it does not provide similar services.

Safe Payment System in “goldenrose.co” is to buy goods safely from the site, you can pay by internet in whole or in part through the payment features of “goldenrose.co” via credit cards, cash on delivery (COD) or any other method of payment may be provided by “goldenrose.co” on the site from time to time. 

You may give “goldenrose.co” unlimited, universal, permanent and irrevocable right, and exempted from charges, licensed to use information, personal data or otherwise which you provided us for the site and/or declared on the same by registration, bidding, purchasing, or during the process of displaying and selling the goods by specific forms to communicate and register, by e-mails or any of the channels available on the site. To operate and promote the site according to Usage Agreement and (Privacy Policy).

2. Aggregated contents on the website are the exclusive property and copy rights of “goldenrose.co” and are protected by copyrights, trademarks, and intellectual and creative property rights and laws.

1. “goldenrose.co” trademarks are not used for products or services outside the market or may degrade its value and credibility.  All other trademarks that appear on the website are owned by its owners not by “goldenrose.co”, who may or not may be affiliated with, linked with or sponsored by “goldenrose.co”.

2. “goldenrose.co”, its own logos, words and other logos on the website are either registered or unregistered trademarks of “goldenrose.co”, and are protected by the rights and laws of ownership of other international and intellectual trademarks.They may not be used without written permission from “goldenrose.co.

1. Any problems of any kind about violation of the User Agreement must be reported.

2. If you think that your intellectual property rights have been breached, you must report “goldenrose.co”.

3. If it is proven that your intellectual property rights have been breached, “goldenrose.co” may oblige to, without prejudice to its interests and rights, stop the user or block it to access to the website and/or cancel its membership or remove its content on the website.

4. “goldenrose.co” also resort to technical and/or legal steps against users who create problems of any kind, such as violation of the intellectual property rights of third parties or deal inappropriately with such User Agreement or our contracts.

5. It is prohibited to display links to the website outside “goldenrose.co” and if they belong to the product displayed on the website only through the tools participating links addresses available through “goldenrose.co”, and the website is responsible for displaying the title for any damage that may result from the entry of viruses or harmful software Whether to “goldenrose.co” or any of its users.

“goldenrose.co” has “Buyer Protection Program” which aims to help buyers to ensure that their purchases are protected in the following cases:

First Case: Receipt of Non-Conforming Goods but still in its Original Condition

§  In case of the Buyer purchases and receives goods that differ from the offered specifications or differ in value or specifications for what mentioned in the offer page, the Buyer could request protection according to “Buyer Protection Program”.

§  This program includes a clause which provides compensation thereto from “goldenrose.co” for value of the goods only. The Buyer shall contact the Customer Service of “goldenrose.co” and ask to return the purchased goods or submit a complaint through the website.

§  The objection should be made by the Buyer within 3 days only from the date of receiving the product. (Period of Protection submitted by “goldenrose.co)

§  Returning the product or disbursement of any compensation shall not be approved in case of non-availability of the conditions for acceptance products’ returning described below.

§  Upon the Management of “goldenrose.co” receives the sent communication; the required actions shall be to investigate the case and the details thereof. If it is decided (by “goldenrose.co”) that the purchased goods are non-conforming; “goldenrose.co “shall indemnify the Buyer under the website’s policy and as seen appropriate by the Management of “goldenrose.co” based on the details of each case. 

1.    “goldenrose.co” shall bear the freight fees paid for shipping the commodity to the Buyer

2.    “goldenrose.co” shall bear the freight fees of returning the commodity from the Buyer.

3.    “goldenrose.co” shall bear the customs fees and the other governmental fees paid for freighting the product to the Buyer.

4.    “goldenrose.co” shall bear the customs fees and the other governmental fees paid for returning the product from the Buyer.

5.    If “goldenrose.co” does not approve the returning request submitted by the Customer and the Customer refuses to receive the returned commodity which is rejected by “goldenrose.co” then “goldenrose.co” shall be entitled to dispose thereof without referring to the Customer.

Second Case: Non-receipt of the Purchased Goods by the Customer.

 If the Buyer purchases goods and does not receive the purchased goods; then the Buyer can ask for the protection according to “Buyer Protection Program”.

 The Buyer Protection Program involves reimbursement by “goldenrose.co” to the buyer of the value of the item only. The Buyer should contact Customer Service for “goldenrose.co” or submit a complaint through the website.

 If the Buyer does not receive the purchased item due to an error made by the Buyer in inserting the address to which the goods shall be forwarded; the Buyer shall incur the following fees:

§  The Buyer shall bear the freight charges paid for loading the commodity to the wrong address

§  The Buyer shall bear the freight charges related to returning the item thereto from the wrong address

§  The Buyer shall bear the customs fees, the insurance and the other government fees paid for freighting the product thereto at the wrong address

§  The Buyer shall bear the customs fees, the insurance and the other government fees paid for returning the product from the wrong address

§  The Buyer shall bear all the other required fees such as freight charges, insurance, and any other customs fees or government fees to return the commodity to the right address.

After the Management of “goldenrose.co” receives the sent communication; the required actions shall be to investigate the case and the details thereof. If it is decided (by goldenrose.co) that the purchased goods have not been received; “goldenrose.co “shall compensate the Buyer under the website’s policy and as seen appropriate by the Management of “goldenrose.co” based on the details of each case.

Third Case:  In case of returning the product due to a defect in the product, while the product is still in its original condition

 If the Buyer rejects within 3 days from receiving the product (Protection Period provided by “goldenrose.co”)

 If the Buyer purchases goods and discovers that there is a defect in the product while the product is in its original case; then the Buyer can ask for the protection according to “Buyer Protection Program”.

§  This program includes a clause which provides compensation thereto from “goldenrose.co” for value of the goods only. The Buyer shall contact the Customer Service of “goldenrose.co” and ask to return the purchased goods or submit a complaint through the website.

§  The objection should be made by the Buyer within 3 days only from the date of receiving the product. (Period of Protection submitted by “goldenrose.co)

§  Returning the product or disbursement of any compensation shall not be approved in case of non-availability of the conditions for acceptance products’ returning described below.

§  After the Management of “goldenrose.co” receives the sent communication, the required actions shall be taken to investigate the case and the details thereof. If it is decided (by goldenrose.co) that the purchased goods have a defect therein and are still in their original case without opening them; “goldenrose.co “shall compensate the Buyer under the website’s policy and as seen appropriate by the Management of “goldenrose.co” based on the details of each case. 

1.    “goldenrose.co” shall bear the freight fees paid for shipping the commodity to the Buyer

2.    “goldenrose.co” shall bear the shipping fees of returning the commodity from the Buyer.

3.    “goldenrose.co” shall bear the customs fees and the other governmental fees paid for freighting the product to the Buyer.

4.    “goldenrose.co” shall bear the customs fees and the other governmental fees paid for returning the product from the Buyer.

5.    If “goldenrose.co” does not approve the returning request submitted by the Customer and the Customer refuses to receive the returned commodity which is rejected by “goldenrose.co”; then “goldenrose.co” shall be entitled to dispose thereof without referring to the Customer.

6.    In case of receiving the parcel from the shipping company in a damaged condition and before opening it; please do not receive the parcel from the shipping company and contact customer service immediately or submit a complaint through the website.

If the Buyer rejects after 3 days from the receipt of product (only in case of approval of returning the product)

 The approval of “goldenrose.co Management” of returning the product is required. The Buyer shall not - in any case - be entitled to oblige “goldenrose.co” to take back the product if the Buyer does not reject within the Protection Period which is 14 days from the receipt of the product.

 Returning the product or disbursement of any compensation shall not be approved in case of non-availability of acceptance conditions of products’ returning described below.

§  The Buyer shall bear the freight charges which are paid for shipping the commodity thereto

§  The Buyer shall bear the freight charges related to returning the commodity thereto

§  The Buyer shall bear the customs fees, the insurance and the other governmental fees paid for freighting the product thereto

§  The Buyer shall bear the customs fees, the insurance and the other governmental fees paid for taking back the product therefrom.

§  If “goldenrose.co” does not approve the returning request submitted by the Customer and the Customer refuses to receive the returned commodity which is rejected by “goldenrose.co”; then “goldenrose.co” shall be entitled to dispose thereof without referring to the Customer.

Fourth Case:  In case of returning the product due to the desire of the Customer while the product is still in its original condition

 If the Buyer rejects within 3 days from receiving the request (Protection Period provided by “goldenrose.co”) 

§  If the Buyer purchases goods and desires to return the product while the product is still in its original case without opening it; then the Buyer can ask for the protection according to “Buyer Protection Program”.

§  This program includes a clause which provides compensation thereto from any billing.com for value of the goods only. The Buyer should contact the Customer Service of “goldenrose.co” and ask to return the purchased commodity or submit a complaint through the website.

§  The objection should be made by the Buyer within 3 days only from the date of receiving the product. (Period of Protection submitted by “goldenrose.co)

Returning the product or disbursement of any compensation shall not be approved in case of non-availability of the conditions for acceptance products’ returning described below.

1.    The Buyer shall bear the freight charges, which are paid for shipping the commodity thereto

2.    The Buyer shall bear the freight charges related to returning the commodity thereto

3.    The Buyer shall bear the customs fees, the insurance and the other governmental fees paid for freighting the product thereto

4.    The Buyer shall bear the customs fees, the insurance and the other governmental fees paid for taking back the product therefrom.

5.    If “goldenrose.co” does not approve the returning request submitted by the Customer and the Customer refuses to receive the returned commodity which is rejected by “goldenrose.co” then “goldenrose.co” shall be entitled to dispose thereof without referring to the Customer.

 If the Buyer objects after 3 days from the receipt of request (only in case of approval of returning the product)

§  The approval of “goldenrose.co Management” for returning the product is required. The Buyer shall not - in any case - be entitled to oblige “goldenrose.co” to take back the product if the Buyer does not object within the Protection Period which is 3 days from the receipt of the product. 

1. The Buyer shall bear the freight charges, which are paid for shipping the commodity thereto 
2. The Buyer shall bear the freight charges related to returning the commodity thereto
3.   The Buyer shall bear the customs fees, the insurance and the other governmental fees paid for freighting the product thereto
4.  The Buyer shall bear the customs fees, the insurance and the other governmental fees paid for taking back the product therefrom.

§  If “goldenrose.co” does not approve the returning request submitted by the Customer and the Customer refuses to receive the returned commodity which is rejected by “goldenrose.co”; then “goldenrose.co” shall be entitled to dispose thereof without referring to the Customer.

There is a number of conditions that must be met collectively not individually, so that the product returning can be accepted:

1. The returning request shall be submitted within a maximum period of 3 days from the date of receipt.
2. The product should be in the same condition when received and not damaged.
3. The product has not been consumed or installed.
4. The products have not been tampered with and are still hold the same serial numbers thereof.
5. The products still hold the price cards, labels, the original cover and the barcode card without removing them.
6. The products are still in their conditions without any missing accessories thereof. 

§  Under the normal circumstances, the freight forwarder shall contact you within a period from three to five working days from the date on which the returning of the commodity is required. Sometimes. However, the matter may require a period of two weeks for the freight service provider to receive the commodity from you.
In the event that some circumstances preclude you from returning the product within 3 days from the date of receipt please call the Customer Service Team in “goldenrose.co” through the number (+971 58 882 9737), or send a complaint via “Contact us page” on the website.  All complaints submitted in this case are investigated and studied independently. In general, all the goods which are approved to be returned must subject to the Consumer Protection Laws and Regulations.

Returning the goods’ value is not performed unless “goldenrose.co” receives the returned goods through one of its approved shipping service providers. The representative or the service provider shall call you to set a time to receive from you the commodity, which you desire to return, within three to five working days from your request to return the commodity.
 

1. “goldenrose.co” takes reasonable measures (physical, organizational and technological) to safeguard against unauthorized access to your personally identifiable information and to safely store your personally identifiable information. However, the Internet is not a secure medium and the privacy of your personal information can never be guaranteed.
2. “goldenrose.co” shall provide your contact information to the shipping company or third parties, including mobile number, e-mail, information of the addresses registered by you and the other necessary information to make a communication between the two parties to complete the process of freight and payment.
3. “goldenrose.co” has no control over the practices of third parties (e.g. Website links to this Site or third parties who misrepresent themselves as you or someone else). You know and agree that “goldenrose.co” may process your personal information that you provide to it for the purposes of providing the services on “goldenrose.co” and for sending marketing communications to you, and that the Privacy Policy of this Site governs our collection, processing, use and any transfer of your personally identifiable information. 

To the extent permitted by law, “goldenrose.co”, as well as its staff, agents, affiliates and suppliers, shall have no responsibility for any direct loss or defaults resulting from using the website. If you are not satisfied with the website or any of its contents, you should stop using it. Additionally, you hereby agree that any unauthorized use of the site and its services, due to your negligence, you will harm “goldenrose.co” and hence we are entitled to use the terms and conditions of this Agreement. 

You hereby agree to provide safety for “goldenrose.co”, its staff, managers, attorneys, and representatives, and to help them avoid any harm caused by demands, losses, defaults, costs, and fees imposed by violating the User Agreement or violating any laws or amendments or trespassing the rights of any third parties. 

No clause of this User Agreement refers to any partnership between you and “goldenrose.co”. Additionally, you are not entitled to compel “goldenrose.co” in any way. All notices you send to “goldenrose.co” shall be sent by email so that “goldenrose.co” responds to this email.

You acknowledge and agree that all notices sent to you from “goldenrose.co” will be published on the site or by the email provided upon registration. You should receive it within 72 hours from the time of sending it. It may send you by postal mail on the address you provided and you should receive it within 7 days of sending. 

You hereby grant “goldenrose.co” the right to, and irrevocably acknowledge and agree that “goldenrose.co” may at any time, transfer all or any part of its rights, benefits, obligations or liabilities under this User Agreement to any of its affiliates without requiring your further specific agreement. “goldenrose.co” agrees to use all reasonable endeavours to provide notice to you of any transfer by way of a posting on the Site. You may not at any time, without the prior written consent of goldenrose.co, transfer all or any part of your rights, benefits, obligations or liabilities under this User Agreement without the prior written consent of “goldenrose.co”.

•          If any clause of this User The agreement shall be deemed invalid, void or for any reason unenforceable, such  clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of this User Agreement.
•       This User Agreement (as amended from time to time in accordance with the terms of this User Agreement) sets forth the entire understanding and agreement between you and “goldenrose.co” with respect to what follows: 

                                          i.    No person who is not a party to this User Agreement shall have any right to enforce any term of this User Agreement.

                                         ii.    If this User Agreement is translated into any language other than Arabic, whether on the Site or otherwise, the Arabic text shall prevail.

This User Agreement is governed by and construed in accordance with, UAE law. This clause will survive any expiry or cancellation of this User Agreement for any reason.

About VAT on sales

• Value Added Tax (VAT) will be introduced starting from 1 January 2018 in Saudi Arabia and the United Arab Emirates (Applicable Countries). VAT will be imposed at 5% on sales and shipping orders through goldenrose.co.
• All prices of products advertised through goldenrose.co will be subject to VAT. However, once you complete the application data, your final price will be reflected in the account.

About sales value-added tax (VAT) on sales to customers in the United Arab Emirates

Under UAE VAT legislation, goldenrose.co will be required to collect VAT on goods shipped and sold within the UAE

For customers residing within the UAE, VAT will be applied in accordance with local legislation and the final price of a request will be confirmed at the time of review and calculation.

For VAT on sales to customers outside the UAE

•         For shipments to any country outside UAE, you will be subject to Value Added Tax (VAT) of 0% (subject to certain conditions). However, there may be additional charges based on the shipping address.
•         Shipments to the other GCC countries (applicable countries for the added value tax) are subject to a tax rate of 5%.
•         These shipments will be assessed for VAT on imports or customs duties based on applicable laws in the country charged to them.
•         Import/customs duties are charged as soon as the shipment reaches its destination.
• ·       For products shipped to Saudi Arabia and any of the other GCC countries, goldenrose.co will evaluate and collect the import duties during the audit and account procedures. These funds will be used to pay the import duties on your behalf to the Customs Department of those countries Import under Order Summary in Account.

VAT rate

• The applicable tax rate will vary depending on the destination and the nature of the goods delivered

For the purchase of goods as a customer registered in the VAT system

If you are registered with the VAT system in any of the GCC countries and you have been issued a tax registration number in that applicable country, subject to the conditions set out below, you may submit your tax registration number when making any purchases from goldenrose.co and we will mention your tax registration number on our invoices.

Terms and conditions of registration in VAT

Before sending your tax registration number, please see the following details. If you are registered with the VAT system in any of the GCC countries and you have been issued a tax registration number in that applicable country, subject to the conditions set out below, you may submit your tax registration number when making any purchases from goldenrose.co.

You may enter your tax registration number only when you agree to and accept all of the following terms and conditions:

• goldenrose.co is the brand name of SAMA AL-KHALEEJ Gold & Jewelry Trading.
• When you enter your tax registration number to purchase from goldenrose.co and after we verify your tax registration number, our system will determine whether your purchases will be subject to VAT and then automatically issue a tax invoice in line with the GCC Agreement and local VAT laws.
• If your purchases are not subject to tax, you may be responsible for calculating VAT if applicable under the GCC Agreement and local VAT laws applicable in the country of registration.
• You will continue to be responsible for any value-added tax or other tax obligations that you must fulfil as a buyer, in accordance with the GCC Agreement and local VAT laws.
• The tax registration number you enter on goldenrose.co must be linked to your business and that such business is registered for VAT purposes in any of the applicable GCC countries.
• All transactions you make through your goldenrose.co the account will be transactions related to the business of you and the activities related to the tax registration number and tax registration certificate you have previously submitted to goldenrose.co.
• Your tax registration number, tax registration certificate and all other data must be correct, accurate and up-to-date, and you undertake to update such data and inform goldenrose.co.
• All data relating to your tax registration number will be collected, processed and maintained in accordance with the terms set forth in the Terms of Use, Sale Notice and Privacy of goldenrose.co.
• goldenrose.co reserves the right to request more information and to verify your goldenrose.co account information (including your tax registration number and/or your tax registration certificate) with you or with the relevant government agencies and agencies, as permitted by applicable law.

 You hereby authorize goldenrose.co to request such information from relevant government agencies and agencies as goldenrose.co deems necessary. Furthermore, you agree to submit any of this information to goldenrose.co upon request.

• goldenrose.co reserves the right to deduct any unpaid tax due if you enter your tax registration number which is found to be incorrect, not in accordance with your business details, or that the tax authorities consider that it is not related to the account holder at goldenrose.co.
• You hereby authorize goldenrose.co to deduct from your credit card or debit card any unpaid tax.
• Agree to receive tax invoices electronically.
• Electronic Tax Invoices will be displayed in PDF format on the My Orders page if ordered through goldenrose.co.
